RIAA losing money in the war they wage against P2P

Wonder how well this goes over when they lobby local governments when they claim file sharers are making them poorer? High priced lawyers on retainers don't qualify you as living in poverty.

Their target is to create FEAR in people that use P2P software, however I think that they can be able to injure P2P world, but not able to kill it!

..just a thought, but was there ever a case brought for copyright infringment against a second-hand book shop or record shop ?

..they actually sell the item, not just swap it, and i doubt any pay copyright fees, i know i never did..

..taking the thought further, surely every child that swaps cards, unless they are clearly labelled for swapping, is also now a criminal, further still if i swap a record i have for one you have then we're both criminals ???

..somehow i think the defence missed the basic point, and wandered off into the legal fantasy land set up by the prosecution..

..oh, and btw, Sir Richard Branson, of Virgin, started off with a chain of second-hand record shops, unless there's a statute of limitations, which doesn't appear to be the case, surely he's the first guy to bust.....

Technically, spy servers can be fully functionnal.
But I wonder if their logs could be legally used as proofs.

I believe (not 100% sure) that in France, this should not be possible (But there's not much French servers left anyway :( )

In France:
P2p is still too young, the judges themselves don't really know what to think about all that stuff.
But for example, if the cops buy some drug from a dealer to gather some proofs, these proofs are not valid and the dealer cannot be condemned (I guess it's because it cannot be proven that he would have actually sell drug if the cops did not request it.)
And since the law is supposed to be the same for everybody, this should be applicable for p2p as well.

If we can trust what we can see in US movies, it seems to be different in the USA. (and as a matter of fact, I do not trust US servers...)

Does anybody know if German or Dutch laws are more similar to French ones or to US ones?
(or if I'm wrong about French laws... :unsure: )


I ask this because the commonly recommended server lists (peerrate, gruk) contain many servers that are listed in my IPFilter (emulePawcio)

first we should know if a server is legal or not =)
and, as far as I know, it's not clear at all in almost all countries =)
we still wait for the first judgement concerning this... for our dear RazorBack, (hoping bile and razorback won't have trouble at all !)

so I bet they could use it if razorback is described as a legal server

anyway, this would really not be the first illegal stuff that would do RIAA/MPAA to reach what they hope :wacko: (last example : employed hackers to try to make a DoS on ThePirateBay servers)

I can't remember if you're right about french laws (about your dealer example), but I Think you're maybe wrong =)

But I'm quite sure that in France the cops (or the "accusator") have no right to incite someone to commit a crime or an offence.
(And I'm sure I have not dreamt about my example, although I'm not sure about the details... it was a long time ago; maybe the cops have not bought, but sell drugs...)

And of course, I'm not sure if a functional ed2k server can be considered as an incitation...


Anyway, since the French laws about p2p are about to change, if you see new French ed2k servers appear, IMHO you should not trust them...
