Today I noticed that emule.net and emule.com has appeard to be aquired by eMule and eMule Plus or by someone on their behalf.
Is this true or are these sites still phishing only smarter?

From their site http://www.emule.com...try/?page=about

About Emule:
eMule is a educational archiving entity whose goal is to bring content to the internet which otherwise would not be provided in mass. Projects under development by eMule include Classical Poetry and Royalty and topics. eMule strives to generate traffic by providing the largest archive possible funded entirely through sponsorships. eMule is based in Marietta, Georgia, USA. For more information about eMule please view our contact page or visit us on the web at: http://www.emule.com/.

I think they're just looking for high web traffic using emule as a name.

Well the truth is that they existed before eMule was born and even offered there help on some situations. Unfortunatly it seems they finally were deceived by the call of money and put in some obscure version on their frontpage - i haven't actually downloaded and checked it, but little doubt that it is not the original adfree package we provide.

Have the developers of eMule ever considered buying these domains to protect naive users. I'm sure that if the developers open a donation for this purpose they will raise the necessary funds in no time...

Cheers :D

You mean like donating to pay off scammers in order to help them making more money even faster and with less trouble (because they will only sell if they think its worth)? I do have a feeling that this is not the best cause for a donation campaign. And even if we paid off the scammers for their hard work, they will have little problems finding new ways to to explot emule, since you don't need a emule.tld for this.

In that case, how 'bout collecting money for a lawsuit?

I think the lawsuit was meant to be for the GPL violation not for the trademark usage.
Three Rings for the Elven-kings under the sky,
Seven for the Dwarf-lords in their halls of stone,
Nine for Mortal Men doomed to die,
One for the Dark Lord on his dark throne
In the Land of Mordor where the Shadows lie.
One Ring to rule them all, One Ring to find them,
One Ring to bring them all and in the darkness bind them
In the Land of Mordor where the Shadows lie.

I think such a thing would be a good way to attract unwanted attention to the project and achieve little else. Law suits are an evil and generally ruining life. Better to just ignore these things and focus on client development IMO ;)

I know it sucks, nobody likes rewarding assholes... but what is the alternative? A lawsuit is a big hassle and no one in the project has the time or patience for it.

Simple: Ignoring them. We aren't saints and can't protect every user from the evil world. We are just as unhappy as you that people make money by exploiting eMule's reputation and our work. But the fact is we can't do to much whats worth doing is in those cases and we won't start any fights which cost our ressources but cannot be won; and there is no way to stop scammers and spammers in general since there are just too many with way too much time on their hands. Also for sure we are not going to support them, by handing over money to such people.
So we have to trust that people are able to find out which sites are spam and which are real. This can be sometimes tricky for newbies, but you can't survive in the net without that ability anyway.
