Sure is possible make a fully working server software in days. But how many years will need to make a project in that level of performance and stability ?

90% of online servers are fake servers, payed by antip2p companies to push fakes, and viruses that are able to use contaminated PC to send DDOS attacks to 'genuine servers'
You cannot fight against them, really.
You cannot find enough Gigabit links able to receive more than xx millions packets per second on one machine.
Forget about servers and use Kad.

Please, turn the server software open-source.
I for sure, will have interest in continue developing it.

He said that the problem in realease the code, is because it can be used to create fakes servers.
But the RIAA/MediaSentry/.... already showed the capability in create fakes servers,
So IMHO releasing it will create less harm than if let the server die.
We already known that the KAD is not a 100% solution for the search needs. It fail in so many aspects.
For example, all the people will keeping searching for "Dj SOMETHING" where KAD fail at <3 characters.
Have the popular keywork problem. Like search for the song "Max dont have sex" from the Eurodance band "Erotic" will generate no hits at all.

I doubts that JEDs still exist.

If that was the case then eMule would have no obligations towards Merkur but in fact it does.

As for your examples: As PacoBell said, the keyword just needs to have 3 letters, the order of the words can be changed for this. Looking for "something dj" instead of "dj something" will work fine. You're right that most people probably don't know this and search for "dj something" first. Maybe the popup box should inform about the possibility of changing the word order?
With "Max dont have sex" (actually it already gives me some results in this form) there is another problem: Some users write "dont", some write "don't" in the filenames. Of course you can use OR for this, but easier is to just type "max don have sex". Leave the "t" away will find both "dont" and "don't" (but that's not possible if it's the keyword). To me it doesn't look like "max" is a too common keyword although the problem exists of course (especially with stop words, like "the whatever" will return far less results than "whatever the")
So, if people know about all those things, Kad is a decent solution IMO.
Maybe someone should write a guide how to peform clever Kad searches...
